Regulation Of Greenhouse Gases Under The Clean Air Act: The Future Is Now

The Environmental Protection Agency (EPA) will begin regulating greenhouse gas (GHG) emissions under both the Prevention of Significant Deterioration and Renewable Operating Permits programs under the Clean Air Act in 2010. Although EPA has proposed a "Tailoring Rule" that will provide limited relief, untold thousands of projects and facilities that were not previously regulated will be affected. Attorney S. Lee Johnson of Honigman Miller Schwartz and Cohn will explain the forthcoming regulations and their impact.
