AAI Benefits: Contiguous Property Owner

An All Appropriate Inquiry (AAI) Phase One Environmental Site Assessment can provide CERCLA liability protection through Contiguous Property Owner Liability Protection. The requirements for Contiguous Property Owner Liability Protection are:

  • Owner of property contiguous to contaminated property owned by another
  • Did not cause or contribute to the release
  • Takes reasonable steps to mitigate the release
  • Cooperates with response actions and complies with AULs
  • Despite AAI, did not know or have reason to know the acquired property was contaminated by releases from the contiguous property
