What the Construction Industry Should Know About Changes to the Storm Water Regulation

Under the new construction and development rule for storm water discharge, the Environmental Protection Agency (EPA) Construction General Permit (CGP) is to be changed, and EPA has recently issued a draft. It incorporates a range of sediment and erosion controls and pollution prevention measures (authorized states will make similar changes). The final CGP is expected by January 2012, and may include additional sampling and testing requirements.
Additionally, EPA expects to issue another draft construction storm water rule by the end of the year. The draft rule may expand the storm water program by including post-construction storm water controls in the CGP, and requiring owners to retrofit the controls in existing development. EPA sent out questionnaires over the summer and fall regarding this proposed rule.
