Upcoming Webinar on Proposed Changes to the Michigan Superfund Rules

The Michigan Legislature along with the Michigan Department of Natural Resources and Environment (MDNRE) have drafted legislation for consideration to amend Michigan's Superfund rules.

Key Points of Change:
  • Operational Memoranda, Guidelines, etc., shall not be given the force an effect of law and shall not be cited by the regulated community for compliance or enforcement purposes
  • Non-Liable parties must provide access to liable parties to conduct response activities, comply with land use restrictions and not impede the effectiveness or integrity of an institutional control 
  • Accountability of the MDNRE for plans received and approved or disapproved by the department
  • Creation of a self-implemented approach to clean-ups
  • Specific time frames for approval of work plans and closure reports
