Under the new construction and development rule for storm water discharge, the Environmental Protection Agency (EPA) Construction General Permit (CGP) is to be changed, and the deadline is June 30, 2011. The new CGP will incorporate a range of sediment and erosion controls and pollution prevention measures (authorized states will make similar changes).
Additionally, EPA expects to issue another draft construction storm water rule by the end of the year. The draft rule may expand the storm water program by including post-construction storm water controls in the CGP, and requiring owners to retrofit the controls in existing development. EPA sent out questionnaires over the summer and fall regarding this proposed rule.
