Data Gaps and the Phase II Recommendation Dilemma

Wednesday, December 23, 2009 by August Mack Environmental, Inc.
Your consultant is your best friend when the Phase I you just ordered came up with no recommendations. How tested is that relationship when there is a recommendation to perform further testing? Yes, sometimes the recommendation to test is a no-brainer. Perhaps when an underground storage tank is discovered at a site for which there is no data to determine if the tank has leaked into the ground. Other times the recommendation to test might not initially make sense to the report user(s) and these...

Phase I: To Screen or Not to Screen?

Wednesday, December 9, 2009 by August Mack Environmental, Inc.
It was just three years ago that the Environmental Protection Agency (EPA) issued regulations outlining the steps a perspective property purchaser must take to comply with the concept of “all appropriate inquiry into the previous ownership and uses of the property consistent with good commercial or customary practice.” This concept of all appropriate inquiry was mandated by the Comprehensive Emergency Response and Liability Act (CERCLA), better known as the Superfund Law or just Superfund, to...

Evaluating the Proposal: Confessions of an Environmental Consultant

Thursday, November 5, 2009 by August Mack Environmental, Inc.

I’m a consultant and I’m here to help you!” These words reminiscent of the proverbial used-car salesman who thinks he is offering you a deal you simply cannot pass up. You probably have gotten this sentiment when your company finds itself in a situation that requires a consultant to remedy its environmental problems. Thus, the selection process begins. After numerous introductions and “pitches,” the long list of available consultants has been short-listed to those few consultants that you are...

Why Should I Have an Attorney Involved in the Audit Process?

Wednesday, October 14, 2009 by Marketing Department
Attorneys can offer confidentiality and privilege.

Any environmental compliance audit should be marked "Confidential" and should be kept separately from other records. If you involve an outside attorney, the audit should be performed under Attorney-Client Privilege. This protects you from providing it to the permitting authority, third-party litigants and the Environmental Protection Agency (EPA). Remember, as a practical matter EPA (and many states) have broad subpoena powers.

If a violation is...

History of eCAP and Why it was Created

Wednesday, October 14, 2009 by Marketing Department

Prior to eCAP® almost everybody did environmental consulting on a peace mill basis. If you needed a Spill Prevention Containment and Countermeasure (SPCC) plan, you contracted out for one. If you needed a Tier II report, you contracted out for one. Companies could easily contract for several different annual reporting requirements.

August Mack saw there was an opportunity for an Environmental Compliance Assistance Program. The concept for eCAP® was formulated in 1999. The first customer of the...

Monday, August 31, 2009 by Due Diligence Account Team

The Michigan Department of Environmental Quality (MDEQ) has developed a proposed cleanup and redevelopment program for the state Superfund and leaking underground storage tank (LUST) programs. The last revision was in 1995 when cleanup criteria was established via Risk-Based Corrective Action protocol, and liability was changed from the federal Superfund concept of joint and several liability (i.e., where any party who owned or operated at the polluted property could be held liable for its...

Thursday, January 15, 2009 by August Mack Environmental, Inc.
Each year, August Mack has the privilege to support our clients with the evaluation and remediation of environmentally impaired sites they are considering for redevelopment. It seems like everywhere one turns, Brownfields are the buzz of the political, development, and environmental consultant communities. From the consultant who sees the...
