Why Should I Have an Attorney Involved in the Audit Process?

Attorneys can offer confidentiality and privilege.

Any environmental compliance audit should be marked "Confidential" and should be kept separately from other records. If you involve an outside attorney, the audit should be performed under Attorney-Client Privilege. This protects you from providing it to the permitting authority, third-party litigants and the Environmental Protection Agency (EPA). Remember, as a practical matter EPA (and many states) have broad subpoena powers.
